First of all, I would like to thank everyone who has helped us in this fight.
Dan, Dave and his wife, Gene, One-eyed Jack, Jon Johnson and all the other folks who have offered encouragement and support. To those who let the village know how wrong they are I also give much thanks.
Well, round one is over but round 2 is coming on 02/12/98. Sorry I haven't gotten this out sooner.
The 'inspector' came to the door and I refused to let him in. I told him that I would allow him to search when he had a warrant that was in compliance with the forth amendment of the constitution. I was informed by the village 'inspector' that this was an inspection and not a search (this is something I keep hearing at the meeting and from the folks at the village hall.)
When he mentioned to me that he felt that if he saved one life by finding a fire violation, his job would be 'worth it', I quoted him a paraphrase of Ben Franklin (my favorite founding father..) 'A man who will give up liberty for security deserves neither liberty nor security. The inspector then showed me his tattoo that represented a special forces group. He is a veteran who served in Vietnam. For this service I sincerely thanked him.
When I asked him what would happen next, he told me the standard party line about an administrative warrant. We then established that if I refused I would be arrested.
Well, that was about it. He was polite. I was polite.
4 units including my own, refused the search. I am very proud of these three families. I then went to the village hall to see if I could slow down the warrants. Not to get out of them but so that there would be time to mobilize the other tenants and let them know what to expect. I will go to jail for this but I want to make sure the others know exactly what is ahead.
The Village employee who is in charge of these inspections (a gentleman from India) has agreed to meet with all of the tenants who refused. Until we meet with him, the 'warrants' will not be issued. I do want to give these folks every chance to do the right thing. So far, with extreme patience, I have not taken a confrontational stance. I am taking a 'more flies with honey' approach for the time being.
Two of the apartments have since told the village that they will comply if given a warrant. The above mentioned meeting may not take place now. I however will still meet with the village alone if I have too.
But even as I type this, tenants in Addison in another building are getting ready for a search. Yes. It is a search. I hope you don't mind if I rant for a second.......
Why in the hell do these folks feel that they can treat people with this kind of disrespect. To some folks, this has got to be a humiliating experience. THIS IS AMERICA. MY FATHER AND UNCLES FOUGHT FOR THIS COUNTRY. What is going on ? Why are people letting this happen? Don't they realize what freedom means? Don't they realize that without freedom, it doesn't matter how safe you are. This is truely a no-brainer.
I wish that I could show BRAVEHEART to every person that lives in this town. We could then play.. let's identify the king here in Addison. Maybe the folks here could truely get an idea of what freedom really means. I am almost in tears as I type this because without freedom, NOTHING ELSE MATTERS. If I cannot be free to live in my own home without a warrantless search of my property, then what's left?

The addisonadvantage website is sending out a second form letter after you respond to a request for additional information on the first one.
I wonder if these folks have the same thing for dinner every day. Just a thought....
I will say that all of my dealings with these folks so far has been very civil and polite. This I fear will soon be breaking down. I confess that my patience is wearing alittle thin and I think VOA (village of Addison) is getting really tired of answering e-mails.
Thanx again to everyone that has helped in any way. The support that I have received has been fantastic. Maybe this is how we get our nation back. Practice on little fights gets us ready for the big ones..
I received another letter from the good folks at the village thru my landlord.

YOUR COOPERATION IN CORRECTING THE VIOLATIONS LISTED ABOVE IS EXPECTED AND WILL BE GREATLY APPRECIATED. PLEASE HAVE MANAGEMENT PRESENT ON FEBRUARY 12, 1998 AT 9:00 A.M. AT WHICH TIME A REINSPECTION WILL BE MADE. IF YOU HAVE ANY QUESTIONS, PLEASE FEEL FREE TO CALL ME.

PLEASE MAKE SURE TO KEEP YOUR APARTMENT IN A SAFE CONDITION BY KEEPING A WORKABLE SMOKE ALARM, POWER STRIPS FOR MULTIPLE ELECTRICAL CONNECTIONS AND FREE BLOCKING THE DOOR WAYS. AS REQUIRED, PLEASE HAVE ONE OF YOUR FAMILY MEMBERS BE PRESENT AT THE TIME OF RE-INSPECTION. OR CALL ME SO THAT I CAN COMPLY WITH INSPECTION.
YOU ARE REQUESTED TO OBEY THE LAW AND SHOW THE APARTMENT FOR INSPECTION TO AVOID LEGAL TROUBLES FOR YOU AND ME. IF YOU HAVE ANY CONCERNS, YOU CAN ADDRESS THEM IS A DIFFERENT WAY, BUT NOT BY REFUSING LEGAL INSPECTION.

I do not fault the landlord. He is intimidated by these folks. He has been a good landlord since he bought the building. Snow removal the first time is snowed this season was awful. However I found out it was because the company he hired forgot this building. The next time it snowed, he had already hired a new company and they did a beautiful job of clearing our parking lot. He even apologized for the previous snow removal. He is trying to do a good job here and I have no complaint against him nor does he have a complaint against me.
UPDATE..
Well, the inspection finally happened. A very dangerous violation was found in our home. One that I am very greatful that the village found. Clearly our lives were in danger and we it not for the village of Addison, surely the lives of everyone in this building would have been in jepardoy.
Our violation was that alittle bit of the paint had worn off of our toliet seat. This exposed wood on our toliet seat was a true threat to the republic and had to be taken care of. This was worth giving up any consttutional rights that I may have had to sacrifice.
The village really did site us for this. Amazing. It was explained to the village that next to the handle on our ice box, our toliet seat is the most abused part of our home. They didn't care.
I would like to thank the Addison Press newspaper for a really balenced article about this illegal search situation. They even put my picture on the front page. This picture probably hurt circulation but it got the word out. This is not over...

P.S. prayer for my wife would be greatly appreciated. Although she is behind me 100 percent, this ordeal has been taking it's toll. It finally came to a head late on the day the first inspection took place and she fainted from a low sugar spell. I got her to drink some pepsi and then she was up all night with an upset stomach. She is more afraid for me than for herself. I will tell you if this does any damage to the woman I love, the gloves come off...
